GENERAL TERMS AND CONDITIONS
(for the online store www.beehivemonitoring.com)
(effective from 1 January 2024)

1. INTRODUCTORY PROVISIONS

1.1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the legal relationships between the company:

(hereinafter referred to as the “seller”) and any natural or legal person who places an order for goods via the e-shop (hereinafter referred to as the “buyer”).

1.2. The buyer may be:

  • a consumer – a natural person who does not purchase goods for business purposes, or
  • an entrepreneur – a person registered in the commercial/trade register or a person acting within the scope of their business activity.

1.3. Matters not covered by these GTC shall be governed by the applicable laws of the Slovak Republic, in particular Act No. 102/2014 Coll., Act No. 250/2007 Coll., the Civil Code (No. 40/1964 Coll.), the Commercial Code (No. 513/1991 Coll.), Act No. 22/2004 Coll. on Electronic Commerce, and Act No. 391/2015 Coll. on Alternative Dispute Resolution.


2. PRODUCT AND PRICE INFORMATION

2.1. All prices in the e-shop are stated in euros, including VAT and all applicable taxes. Shipping and cash-on-delivery fees are listed separately during the ordering process.

2.2. The seller reserves the right to change prices prior to the binding confirmation of the order.


3. ORDERING AND CONCLUDING A PURCHASE AGREEMENT

3.1. The buyer selects goods, payment method, and delivery method via the order form on the e-shop.

3.2. After submitting the order, the buyer receives an email confirmation. The purchase agreement is concluded upon delivery of the seller’s binding confirmation.

3.3. The buyer may review and modify entered data before completing the order.


4. PAYMENT TERMS

  • Advance payment – via bank transfer, credit card, PayPal
  • Cash on delivery – payment upon delivery (only in Slovakia and Czech Republic)
  • Cash – upon personal pickup

The invoice also serves as a tax document and warranty certificate. The payment due date for transfers is 7 days.


5. DELIVERY TERMS

5.1. Delivery options: courier service, personal pickup at the company headquarters or production site (Beňadická 19, 851 06 Bratislava), Slovak Post.

5.2. Usual delivery time is 2 – 5 business days after payment is received (or after order confirmation in the case of cash on delivery).

5.3. Risk of damage to goods passes to the buyer upon receipt. The buyer must check the packaging for damage.


6. CONSUMER’S RIGHT OF WITHDRAWAL

6.1. The consumer has the right to withdraw from the contract within 14 calendar days of receiving the goods without giving a reason.

6.2. The consumer may use the model withdrawal form (Annex 1 of these GTC) and send it with the goods to the seller’s address.

6.3. The consumer must return the goods within 14 days of withdrawal. Return shipping costs are borne by the consumer.

6.4. The seller will refund all payments (excluding shipping) within 14 days of receiving the withdrawal notice, but not before receiving the returned goods or proof of dispatch.

6.5. The consumer is liable for any reduction in value of the goods resulting from handling beyond what is necessary to determine their nature and functionality.


7. LIABILITY FOR DEFECTS AND CLAIMS

7.1. The seller is liable for defects that occur within 24 months of receipt by the consumer (12 months for businesses unless agreed otherwise).

7.2. The buyer submits a claim via email, in writing, or through online chat. The goods should be sent to the seller’s address with a defect description and proof of purchase.

7.3. Claims will be processed within 30 days; the buyer will be informed via email.


8. SPECIAL PROVISIONS FOR ENTREPRENEURS

8.1. The entrepreneur acknowledges that the provisions of §§ 419 et seq. of the Commercial Code take precedence over consumer protection law.

8.2. The warranty period for entrepreneurs is 12 months unless agreed otherwise.


9. PERSONAL DATA PROTECTION

Personal data processing is governed by GDPR (EU 2016/679) and Slovak Act No. 18/2018 Coll. Details are provided in the Privacy Policy available on the seller’s website.


10. ALTERNATIVE DISPUTE RESOLUTION (ADR)

The consumer may contact the seller with a request for redress. If rejected or unanswered within 30 days, the consumer can contact the Slovak Trade Inspection or use the ODR platform.


11. CONDITIONS FOR PROPER USE OF DEVICES

11.1. The electronic control unit must be securely fixed to the hive structure or another stable element. Hanging or unsupported installation may damage the device and lead to inaccurate measurements.

11.2. The user must keep the device clean. Regular cleaning of connectors, sensors, and surfaces using a dry or slightly damp cloth is required. Do not use water jets.

11.3. The hive scale is intended solely for weighing bee hives and monitoring their status. Use for other purposes (e.g., weighing people, animals, cargo) is prohibited and voids the warranty.

11.4. The user must monitor battery status and recharge or replace it according to the user manual. Leaving the device with a dead battery may damage the electronics.

11.5. If the electronics box is opened (e.g., for battery replacement or diagnostics), the device must be recalibrated before further use.

11.6. Proper calibration may include disconnecting and reconnecting sensors to the mainboard. Follow the manufacturer’s recommended procedure.

11.7. In case of anomalies or safety incidents (e.g., power failure, sensor damage), the device may enter protection mode and shut down. A reset is required as per the manual.

11.8. If a firmware or software update is available, the user is required to perform it to ensure full functionality and safety.

11.9. The device must not be exposed to high temperatures above 80 °C, especially in direct sunlight or on metal surfaces. Excessive heat may cause permanent damage.

11.10. To ensure proper data download, the device must be within Bluetooth range. Obstacles like metal hives or walls may reduce signal range. Recommended distance is within 5 m with direct line of sight.

11.11. The device must be properly sealed, especially after battery replacement or maintenance. Improper sealing may result in moisture ingress, component damage, and loss of warranty.

11.12. The buyer must use the device in accordance with technical specifications and manufacturer’s instructions. Failure to comply may void the warranty under § 620 of the Civil Code.


12. FINAL PROVISIONS

12.1. The seller reserves the right to amend these GTC; any new version will be published on the website with the effective date.

12.2. These GTC become effective upon publication and form an inseparable part of any distance purchase agreement between the seller and the buyer.
